One time Kennedy took sides with Liberals on the court’s 2015 decision in Obergefell v. Hodges, permitting same-sex marriage nationwide.
Kennedy is now 80 years-old and is getting ready to step down from the Supreme Court. CNN reported, that although he has not publicly announced it, he will do so in the next year.
According to the AP, the speculation has risen after Kennedy reunited with his clerks over the weekend, a meeting that was pushed up a year from its original date.
Kennedy leaving could mean bad news for Democrats, as Trump will get to nominate who he wants to replace him. The Supreme Court nominations have also become increasingly political.
Senate Republicans voted earlier this year to change the chamber’s rules to only require 51 votes to confirm nominees to the high court. This was due to Democrats’ efforts to block Gorsuch’s confirmation.
